Government Regulation, Accidents, and Insurance Administrative and Agency Counsel
The Firm recently successfully represented an individual and several corporate entities in defending allegations of civil and criminal wrongdoing during a state proceeding with the Office of Inspector General. The Firm contended throughout the proceedings that the allegations were false and baseless, and had been improperly filed by local governmental agency officials against the Firm’s clients. The Firm assisted the clients in preparing evidence showing their innocence, and all allegations and potential charges of every kind were dropped. The clients were all reinstated to full health care licensing privileges and cleared of any/all claims of wrongdoing. The clients were pleased with the outcome, though it is always an ordeal to be falsely accused. Fortunately, in this case. the system worked correctly.
Contract and Property Law, Construction and Condo Law
The Firm represented a condominium association, and assisted the association with revising condominium bylaws to address short-term rentals, per the condo board’s preferences for new rules to regulate short-term rentals.
Employment Law
The Firm represented a senior executive level professional, who was wrongfully terminated from his employment by a Michigan college. The Firm attempted pre-suit negotiations with the college, which were productive but not sufficient to resolve the dispute in a timely manner. So, the Firm filed suit for the client for breach of contract and other statutory violations. Fortunately, the college and client were able to reach a confidential settlement relatively quickly, which brought matters to a close on very favorable terms for the client, and the dispute was resolved quickly and without great expense.
Contract and Property Law
A Grand Traverse Bay waterfront property owner was unfortunately sued by a neighboring property owner, who raised a variety of allegations, including flooding of her parcel allegedly caused by the client or his property. The neighbor aggressively litigated, seeking injunctive relief and money damages from the client under a number of legal and equitable theories. The Firm defended the client in court and staved off any injunctive or damage relief being granted to the neighbor whatsoever. The case was eventually settled in facilitative mediation, which can be a good and productive process to resolve disputes.
Employment Law
Two government employees were retaliated against, and baseless charges were made against them with the Michigan State Police. However, the Firm assisted the employees in defending themselves by providing the MSP with the facts and evidence, to contradict the false allegations filed by the government employer. The Michigan State Police closed their file, finding the “charges” made against the employees to be without foundation and baseless, giving the Firm’s clients a big win. Also, the Firm filed civil suits against the government on behalf of the two employees, to seek further justice in the civil court system for both employees.
Contract and Property Law
A builder was sued by a property owner, who claimed that the builder had not completed work he was asked to do. However, the property owner had interfered with the progress of the project by constantly adding on new tasks and also refusing to pay bills as they came due, making it impossible for the builder to move forward with the project any further. The Firm assisted the builder in defending himself, by filing an answer, affirmative defenses, and counterclaim against the property owner to ensure that a just outcome would be obtained.
