Recent Win #1:

A husband and wife were shortchanged by a construction contractor who collected tens of thousands of dollars from them, and then failed to deliver required goods and services to complete the construction work on their family home. The firm brought suit against the contractor’s company and the owner individually for fraudulent misrepresentation, conversion, violations of the Michigan consumer Protection Act MCL 445.903, and violation of Michigan’s builders trust statute MCL 570.151, which makes a contractor personally liable for misappropriating or misusing fiduciary funds held in trust for a construction project.

Recent Win #2:

The firm assisted a family-owned limited liability partnership with substantial mineral and oil rights and litigated the dispute with a former managing partner. The dispute was highly contested through the local circuit court and the Michigan Court of Appeals with the firm prevailing on behalf of its client (the partnership) at each of the steps of the litigation. Recently, the Michigan Supreme Court also issued an order that resolved the matter completely and finally in favor of the firm’s client, much to the client’s happiness.

Recent Win #3:

A homeowner made payments on a house for many years, including during the years his ex-wife lived in it after their divorce and before her death. After she died, there were questions about whether he would be compensated for his financial interest and contributions to the property. The firm assisted him with filing suit and reaching a fair settlement for his substantial financial contributions over the years.

Recent Win #4: 

A husband and wife owned a home together. They homeowners hired a contractor to do construction work on their property. Unfortunately, the contractor did a bad job with significant poor workmanship and incomplete work. The firm filed a lawsuit of their behalf and obtained a judgment for more than $85,000 in their favor of the homeowners against the contractor himself, as well as his company. The Court system can provide justice for homeowners wronged by contractors.

Recent Win #5:

Disputes amongst neighbors can lead to many practical problems, and in some cases litigation. The firm recently assisted Traverse City homeowners with resolving a dispute with some neighboring property owners. The neighbors sent a letter raising allegations that the homeowners’ property was causing or contributing to water runoff and other problems on their adjacent property. The firm assisted the homeowners in negotiating and reaching a resolution of these problems quickly, without any litigation.

A waterfront homeowner was sued by his neighbor for a host of claims. The firm assisted the homeowner in defending the case and working toward a reasonable resolution to put the matter to rest.

The firm recently assisted a homeowner who was cheated out of more than $30,000 by her builder. The homeowner made a large deposit with the builder to have work done on her home, but the builder refused to show up and do the work. After attempts to
negotiate failed, the homeowner hired the firm and the Firm obtained a judgment of over $100,000 in her favor against the builder’s company, and its owner individually.

The firm assisted a condominium association in collecting overdue fees and assessments from a unit owner, who refused to pay his bills and assessments.

The firm assisted condominium association with updating and amending its master deed. The condominium act allows a Condo Association to amend its condo documents to meet the Association’s changing needs over time, and to respond to new challenges
that arise over time, such as short term rentals.

A homeowner had a dispute with the neighbor, who wanted a drainage easement running through his property better controlled. The firm assisted the homeowner with negotiating a buyout and agreed-upon resolution that was satisfactory to both sides.
